Dear Mr. Secretary,

Thank you for co-sponsoring Senate Resolution 543 regarding international parental child abduction. Left behind parents were very happy to learn that it was passed by unanimous consent in the United States Senate. We were also happy to learn that Japan is named in the resolution three times for these ongoing abductions. As you know, there is still much work to be done to protect children from the horrors of international parental child abduction to and denial of visitation and access within Japan. Your confirmation as Secretary of State could not have come at a better time.

 

Left behind parents have been making some progress on the issue of children's rights in Japan, but it has been too slow and painstaking, and there is still much work to be done. Meanwhile, the time lost with our children during their developing years can never be recovered, and our loving relationships have been severely damaged. Therefore, we welcome your knowledge of the problem, experience in working on such cases, and desire for a solution. We note that in 2003 you played an instrumental role in the return of the two children of Ms. Nina Streeter taken to Egypt then Cuba. We note your work on the case of Mr. Colin Bower and his two boys taken to Egypt, which is still ongoing. We also note that you signed a letter with 21 colleagues in the Senate addressed to President Obama in November 2009 regarding the situation of international parental child abduction to Japan. The same kind of assistance in your position as Secretary of State is needed to help recover the children abducted to or denied access within Japan.

 

Your help is needed to press the government of Japan to resolve this crisis as soon as possible. Please make this issue a top priority in your tenure as Secretary of State and do all you can to help our children once again enjoy their human right to be with and have meaningful access to both parents. It has been a long and extremely challenging struggle to protect and ensure the rights of children in these cases. We grieve constantly over the inability to see our children, yet abducting parents are always granted sole custody in Japanese family court. This occurs whether the abducting parent is the mother or father, Japanese or non-Japanese. Parental child abduction is not illegal in Japan for the first parent who takes the child. However, left behind parents are arrested if they try to recover their children. Several parents have been driven to suicide because of this heart-wrenching loss. We will continue to struggle on behalf of our children and look forward to working with you in this endeavor, which is of vital importance to their well being. Thank you very much.

　国際的な子どもの拉致における上院決議543を共同提案いただき、ありがとうございます。子どもを連れ去られた親は、アメリカ上院議会にて、全会一致にて決議が採択されたことをとても喜んでいます。また、同決議において、子どもの拉致を続ける日本が名指しで三度も非難されていることも高く評価しています。ご存知の とおり、国際的な子どもの連れ去りの恐怖から子どもを守り、日本国内での子どもとの面会やアクセスへの拒否に対して、やるべきことは多数あります。国務長官へのご就任は、他にない最重要な時期であります。　

　子どもを連れ去られた親たちは、日本における子どもの権利において、多少の前進も得ました。しかしながら、変化は遅く、つらい道のりながらも、やるべきこと はまだま多数あります。子どもの成長は早く、その間の失われた時間は取り戻すことは出来ません。そして愛情に溢れていた親子関係は、とてつもなく傷つけら れています。故に、私たちはこの問題に対するあなたの知識や、こうした事件における経験の豊富さを歓迎するとともに、問題の解決を欲しています。私たち は、2003年にあなたがエジプト次いでキューバに連れ去られたMs.Nina Streeterの二人の子どもの帰還に重要な役割を担ったことに注目しています。Mr.Colin Bowerの二人の男の子がエジプトに連れ去られ、今も連れ去られたままである事件に対するあなたの取り組みに注目しています。そして2009年の9月に、日本の子どもの連れ去り問題に21名の上院議員と共に、オバマ大統領への要望書に署名されていることに注目しています。日本に連れ去られ、もしくは日本国内でのアクセスを拒否されている子どもたちを取り戻すために、国務長官としての同様なサポートを必要としています。　

　この問題を解決するために、日本政府に圧力をかけていただくことを必要としています。国務長官としての在職期間中は、この問題を最優先事項としていただき、 私たちの子どもたちが、両方の親への実りあるアクセスを持ち、もう一度子どもとしての権利を享受できる様、でき得る全てのことをしていただき助けていただ きたくお願いいたします。こうした事件において、子どもの権利を守り確保することは、長く極めて困難な苦難を伴ってきました。私たちは子どもに会えないことを常に深く悲しんできました。しかしながら、日本の家庭裁判所では常に子どもを連れ去った親に単独親権が与えられます。連れ去り親が母親であろうが父親であろうが、日本人であろうが外国人であろうが、こうしたことが起きています。最初の子どもの連れ去りは日本では違法ではありません。しかしながら、子ど もを連れ去られた親が、子どもを取り戻そうとすると逮捕されるのです。この心を引きちぎられる様な喪失により自殺に追い込まれた親もいます。私たちは、子どもたちのために戦い続けるとともに、子どもたちの幸せにとって極めて重要であるこの問題に、あなたと共に尽力することを楽しみにしています。

Gracias por apoyar la Resolución del Senado 543 sobre sustracción internacional de menores. Los padres que sufrimos dicha situación estamos contentos de saber que dicha resolución fue aprobada por unanimidad por el Senado de EEUU. También estamos contentos al saber que en dicha Resolución se nombra a Japón en tres ocasiones. Como ya sabe hay todavía un largo camino por recorrer para proteger a los niños del horror de las sustracciones internacionales y sobre la negativa a las visitas y contactos por parte de las autoridades japonesas. Su nombramiento como Secretario de Estado no podía llegar en mejor momento.

Los padres no custodios hemos hecho algunos progresos en cuanto a la defensa de los derechos de los niños japoneses, pero el proceso es lento y todavía queda mucho por hacer. Mientras tanto el tiempo pasa y los niños pierden la oportunidad de estar con los otros padres, tiempo que es imposible de recuperar por lo que la relación con ellos queda deteriorada de forma irreversible.Por otra parte hemos de agradecerle el seguimiento que ha hecho de cada caso, así como su experiencia trabajando en los mismos y su deseo de solucionar todos y cada uno de los mismos. Somos conscientes de su trabajo en 2003 para recuperar los dos hijos de de la sra Nina Streeter llevados a Egipto y posteriormente a Cuba. Conocemos tambien sus esfuerzos en el caso del sr Colin Bower y sus dos hijos llevados a Egipto, caso aún no cerrado. También somos conscientes que usted firmó una carta en noviembre de 2009 junto con 21 colegas del Senado dirigida al presidente Obama explicando la situación de las sustracciones internacionales con Japón. El mismo tipo de asistencia sería deseable para recuperar a los niños sustraidos o a los que se niegan contactos en Japón.

Su ayuda es necesaria para presionar al Gobierno japonés para resolver esta crisis lo antes posible. Por favor haga de esta cuestión una prioridad como Secretario de Estado y haga lo posible por ayudar a nuestros hijos una vez más para que puedan disfrutar de los Derechos Humanos y disfrutar de ambos padres.Ha sido una lucha larga y extremadamente dolorosa intentar asegurar los derechos humanos de esos niños. Luchamos constantemente contra la imposibilidad de ver a nuestros hijos, los padres sustrayentes son siempre protegidos por los juzgados de familia japoneses. Esto ocurre ya sea la madre o el padre los sustractores, ya sean japoneses o no. La sustracción de menores por el primer progenitor en realizarla no es ilegal en Japón, pero el padre que intenta recuperarlos es arrestado. Muchos padres han llegado al suicidio a causa de esta dura separación. Continuaremos en nuestra lucha por nuestros hijos y esperamos  contar con su colaboración, así como con su solidaridad, en esta aventura, que es de vital importancia para el bienestar de los implicados.
